Dupe Zappa Software Licence Terms

1. Licensor and scope

Dupe Zappa is developed, licensed, and supported by MerginIT e.U., Jonas Fröller, Nußböckstraße 92, 4060 Leonding, Austria. Contact: support@merginit.com. Full company information is available in the MerginIT imprint.

These terms apply to Dupe Zappa obtained directly from MerginIT or an authorized reseller. A store or checkout provider may impose additional buyer terms for the transaction.

2. Purchase channels

Direct website purchase

Lemon Squeezy acts as Merchant of Record and authorized reseller for direct website purchases. This means the purchase transaction is between the customer and Lemon Squeezy, while MerginIT supplies the software licence, activation, updates, and product support. Lemon Squeezy's Buyer Terms and Privacy Policy also apply.

Microsoft Store purchase

Purchases made through Microsoft Store are billed, delivered, licensed, and managed through Microsoft Store under Microsoft's applicable terms. They do not include a separate MerginIT licence key. A Microsoft Store entitlement and a direct website licence are separate and are not automatically interchangeable.

3. Licence grant

Each purchased direct licence grants the customer a perpetual, non-exclusive right to install and use Dupe Zappa on one device at a time. The licence may be used for personal use or internal business use. Each additional concurrently activated device requires its own licence.

The licence may be moved to another device by deactivating the previous device first. If the previous device is lost, damaged, or unavailable, contact support for an activation reset. MerginIT may review unusually frequent resets to prevent misuse.

The licence belongs to the original customer and may not be sold, rented, sublicensed, shared as a service, or transferred to another person or legal entity without MerginIT's written permission.

4. Delivery and activation

For a direct purchase, the customer receives access to the website installer and a licence key or equivalent entitlement electronically. The installer may be publicly downloadable, but paid functionality requires a valid entitlement. The customer is responsible for providing a working email address and retaining the purchase receipt and licence information.

5. Updates and price changes

A direct Dupe Zappa licence includes all future Dupe Zappa updates that MerginIT releases for the product, without an additional update fee. This does not promise that updates, new features, or compatibility with future operating systems will be produced indefinitely.

Prices may increase as Dupe Zappa matures and leaves Early Access. Existing customers keep the licence they already purchased and are not charged the later price for that licence.

6. Early Access

While identified as Early Access, Dupe Zappa is still maturing. Features, workflows, and technical requirements may change. Early Access does not reduce statutory warranty or consumer rights, and it does not authorize material changes that would violate mandatory law.

7. Permitted use and restrictions

You may not:

• circumvent activation, licence, or security controls;
• distribute licence keys or unauthorized copies;
• resell, rent, sublicense, or provide Dupe Zappa as a hosted service;
• reverse engineer or modify the software except where applicable law expressly permits it; or
• use the software unlawfully or to infringe another person's rights.

8. System responsibility and backups

Dupe Zappa performs file-management operations that can move, rename, or delete data. Review previews and exclusions carefully and maintain an independent, tested backup of important data. Recycle Bin and undo features reduce risk but are not substitutes for a backup and may not be available for every operation, storage device, or failure scenario.

9. Statutory warranty and support

MerginIT provides the statutory conformity, warranty, update, and remedy rights required by applicable law. Nothing in these terms excludes or limits rights that cannot lawfully be waived. Product and licensing help is available through the Support page.

10. Refunds, withdrawal, and licence revocation

Refunds and statutory withdrawal rights are described in the Refund and Withdrawal Policy. When a direct purchase is fully refunded or lawfully reversed, the corresponding licence and activations may be revoked.

11. Liability

MerginIT is liable without limitation where liability cannot lawfully be excluded, including for intentional misconduct, gross negligence, personal injury, and mandatory product-liability or consumer-protection claims. For other claims, liability is limited only to the extent permitted by applicable law. Customers must take reasonable steps to limit avoidable loss, including maintaining backups.

12. Governing law and disputes

Austrian law applies, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods, but this choice does not deprive consumers of mandatory protections of their country of residence. Mandatory statutory rules determine jurisdiction for consumer disputes.

13. Changes to these terms

The version accepted at purchase governs that purchase. MerginIT may update these terms for future purchases. Material changes affecting an existing licence will be communicated where required and will not remove acquired or mandatory rights.
